NJ Law enacted to protect menhaden from reduction fleet. THis happened a few years ago, but why can't it happen in Virginia??

BE IT ENACTED by the Senate and General Assembly of the State 4
of New Jersey: 5

1. R.S.23:3-51 is amended to read as follows: 7
23:3-51. a. A person intending to take menhaden with purse or 8
shirred nets in any waters in the jurisdiction of this State, including the 9
waters of the Atlantic ocean, within [3] three nautical miles of the 10
coast line of this State, shall apply to the commissioner for a license 11
therefore. The commissioner, upon [the] receipt of the application and 12
payment [to him] of the fee [provided in section 23:3-52 of this 13
Title] required pursuant to R.S.23:3-52 , may, [in his discretion] at 14
the commissioner's discretion, issue to the applicant a license [,] to 15
take menhaden [with purse or shirred nets] , except as prohibited in 16
subsection b. of this section . The license shall be void after December 17
31 next succeeding its issuance. 18
b. Notwithstanding the provisions of subsection a. of this section 19
or any other law, or any rule or regulation adopted pursuant thereto, 20
to the contrary, the commissioner shall not issue a license for the 21
taking of menhaden, and no person may take menhaden, in State 22
coastal waters, including Delaware, Great, Raritan, and Sandy Hook 23
bays, for the purpose of reduction, including conversion to fish meal, 24
oil, and other components. 25
c. This act shall not affect the taking of menhaden in State coastal 26
waters for the use as bait for commercial or recreational purposes. 27

This bill prohibits the taking of menhaden in State coastal waters, 35
including Delaware, Great, Raritan, and Sandy Hook Bays, for the 36
purpose of fish meal reduction. Under the bill, the licensed taking of 37
menhaden in State coastal waters for use as bait for commercial or 38
recreational purposes would continue to be permitted.
