You should not mention "need crew to split fuel" as a requirement to fish with you. If a fed takes you up on that offer as an undercover agent (and they do) you could be charged for running an unlicensed charter service. No pun intended. It happens. Best to let anybody that fishes with you make the offer afterwards. Do not solicit it ahead of time or on a web site. just friendly advice.

Rusty,
You are right. But I am licensed and insured, just like to get out and fish with other folks. Looking forward to retireing in 4 years to charter.

 Well, in your case I guess I was wrong. That's really nice of you then to offer to take people out fishing with you for only the fuel expense. Sounds like you will become a legend in the Charter Industry in the future. I wish you well and hope you become very successful in the business.

OK, I know this warning is well meaning and may not apply in this particular case, but I think that these internet rumors about fuel sharing are largely unfounded, or at least exaggerated. This seems to be almost all based on a very unusual situation....a guy who actually had a website set up, like a business, setting very strict conditions for fishing on his boat, including monetary compensation. And even then, did that case ever go to court? I know the Coast Guard got involved and he took down the website, but that's a lot different than saying that this is established law.

People agree ahead of time to share expenses on all sorts of things, including fuel. Heck, the DC-area would grind to a halt if a lot of folks didn't agree to carpool in exchange for splitting fuel/commuting costs. Unless someone can point me to a case that says that some fishing buddies agreeing to share fuel/bait expenses constitutes an illegal charter, I'm simply not worried about it. Maybe such a case exists, but if so, I'd love to read it, particularly the unique facts that gave rise to it. In this economy, and given our precarious petroleum-reliance situation, I dare the government to discourage folks from splitting fuel costs, even if folks agree to do so ahead of time.

Of course, I say this for selfish reasons.....I hope some day to fish that area as a HO if I ever get the time....Drum in the spring, Spades/Sheep in the summer, etc:yes:.....and I'll need to offer a big chunk of the expenses ahead of time to coax people to allow a bottom feeding, carpet bagger lawyer onboard.:fishing2:

I think your right on the money. But in todays society Rusty has some legit points. I like the safety factor of the licenses and documents to protect me, but thats just me. I don't want anyone to shy away from "hosting" fellow anglers to share expenses and experiences with others just keep in mind they can not and shouldn't be in it to make a buck! As for my crew for Wends and Thurs I am up front on fuel burned and the "Smartcraft" will tell us exactly what the 3 way split will be (simple math even for me)!

By the way I have a full boat both days, thanks to all for the response. Hopin for some pics to post!
