    Default Lawyer?

    Not a bad as some of the fishing regs I have read, but still not used to reading so many rules to fish and hunt. Here is one I would like to make sure I am not going to break.

    Im pretty sure this is to keep people from hunting in their Cul-de-sac, but Im trying to picture this boundry. Anyone have a picture of this on a map?

    I am planning on jump shooting ducks in westneck creek, and Im pretty certain this is not in this boundry.

    This was copied from the Local virginia beach Ordinances.


    57. No discharge of firearms north or west of a line from the Chesapeake-Virginia Beach boundary; thence northwardly along North Landing Road; thence eastwardly along Indian River Road; thence northeastwardly along New Bridge Road; thence eastwardly along Sandbridge Road to the Atlantic Ocean, or across any land north of False Cape Park and east of Shipps Bay and Point Creek. No discharge of rifles larger than .22 south of this line except muzzleloading rifles may be used to hunt deer during the firearms deer season.

    58. Shotguns firing pellets lawful on certain agricultural lands of fifty contiguous acres or more, and on certain lands south of a line from the Chesapeake-Virginia Beach boundary, thence northeastwardly along Elbow Road; thence southeastwardly along Salem Road; thence northeastwardly along North Landstown Road; thence southeastwardly along Princess Anne Road; thence eastwardly along Sandbridge Road to the Atlantic Ocean. The property must be permitted by the City Manger for this purpose.

    If there is a question, dont push it. Next thing you know, youre walking out with a couple of green heads and the cops meet you at your truck. Worse yet, they sneak down to the creek and scare the s out of ya and run you off any way because the neighbors are *****n. Dont put your self in that position. No fun looking over your back while hunting.

    read va code 28.2-1200, 1202

    1200- all tidal water belongs to the people of the commonwealth for fishing, fowling, hunting and oystering.

    1202- riparian owners own to the mean low water mark

    translation- as long as you aren't shooting towards a house or over a road, you are legal and the cities can't regulate it. I dropped that code on portsmouth pd last week and they told me to have a nice day.

    The are certain properties that are deeded to which the owner will own to the "mid-stream or mid channel", not LMT mark. Some deeds are wrtiten as "boundary defined as LMT mark, or mid-channel, whichever is less"....meaning the area could go dry and the property line would not extend beyond middle way of the water laden area. Granted these are very shallow places, but tidal, nonetheless. As you know - there are no absolutes when dealing with property rights.

    You are somewhat correct. Most of those deeded midstream rights in tidal waters are 'Kings Grants', meaning they were deeded prior to 1779. There are very few of them and none in that area. Most are in the Williamsburg area (2). However, In non-navigable inland waterways, It's a whole new ballgame. Ie. Jackson River in Bath County. I was looking on the map and that creek looks safe up to Indian River Bridge. I've never been there but it looks 'Ducky'. Let me know how you do!

    Some of the areas of topic have become so developed you could have as much or more luck with a LOAF OF BREAD AND A BURLAP SACK, you could leave the shotgun at home.[wink]
