    Charter boats are classified as recreational not commercial fishermen. Commercial fishermen sell their catch, while charters make their profit from taking people out to go recreational fishing. However for the purposes of the federal Lacy act, charter boats involve commerce so poaching charters can be held accountable for the catch entering commerce.
