Friday the 13th is hopefully unlucky for Joseph B. Janda Jr.
Don't recognize the name - well he has 43 cases from DNR.The guy is only 22 years old.Let's hope the judge finally hands down a sentence that gets his attention.This time it is for having undersized oysters but our hero has charges for under sized crabs as well.

43 times - unreal.The Sunpapers in Dec. 11, 2008 did a story on him.Bet it made his father really proud :rolleyes:.

If you got time - drop an E-mail to the St. Mary's court system.

My, it seems this young lad is in need of some proper disciplinary techniques. Let's start a petition to the state to save the state money. We'll outsource judicial matters pertaining to DNR to TidaFish! Hell, I think we could arrange for a fair trial...followed by a top notch execution. I got an acre we could use to dump the bodies...I mean to inter the dearly deceased. :thumbup:

That seems a little extreme. For now, let's start out with a good old fashioned whippin'. I have a leather belt that would be perfect that I would be willing to donate to the cause. My right hand is busted up so someone else would have to administer the punishment One smack, accross a bare ass, for each illegal crab or pound of fish. It may not stop them, but, it will get their attention. If these guys want to act like children who can't follow the rules, let's treat them like chldren who can't follow the rules.

If people poached deer, rabbits, squirrels or any cute furry critter in the amounts they do fish, the masses would want them tarred and feathered. Could it be that people who do not fish, think of fish as just a source of food, the way they think of cows and chickens? Purchased by the pound at the grocery store and maybe even think these poachers kept the price of fish down.

Look at the way people cry when the State has a managed hunt at Loch Raven or Goucher College? These hunts are for the good of the deer, but, it doesn't stop people from from protesting to try to stop them. If someone was caught with a ton of poached deer it would make national news and the public outcry would be deafening. When it comes to fish, most people don't read it or just don't care.

This started out as a post on accountability, but, I think I just convinced myself that Striped Bass should be a sportfish. No profit, no poachers.

I'll climb down off the soapbox now.

I encourage everyone to go the CCA link above and submit a letter to the judge. It is easy and only takes a few minutes. What I wrote is below...


Dear Honorable Richard Fitz,

I am sick and tired of waterman who are often repeat offenders for numerous poaching violations getting away with minimal fines and little to no punishment. Some of these poachers have literally dozens of violations, yet they continue their illegal ways with impunity. Their callous disregard for the bay, the citizens of Maryland and the honest waterman is disgraceful. Even more disgraceful is the factthat there is no deterrent to make them stop and that the legal system in Maryland is unwilling to send the message that these crimes are serious. The Chesapeake is being ravaged while our political leaders and the judicial system turn a blind eye.

I implore of you to vigorously prosecute the case of Mr. Janda and if he is found guilty to assign the maximum penalty permitted by law. A message must be sent that this illegal behavior will no longer be tolerated. Please stop poachers now.

I am on CCA's email alert list and saw the notificationof Mr Janda's trial before I went to tidalfish today and immediately sent the following email:

This person who you are prosecuting for crimes in your county has not learned from the first 42 charges brought against him, so would you please prosecute him to the fullest extent possible.

If you get a conviction, please remind the judge that the slap on the wrists this person has received in the past have not deterred him from continuing to violate the laws of this state that protect our natural resources and he should be given the maximum penalty allowed.

Let's see how many emails we get sent and see if it has an effect. Then go beat down the state house doors if it does not.

--I, Cannot understand how we as Law Abiding Americans , Can as individuals Or as a Letter Writing Group (CCA) , single out another American, To be Targeted W/O knowing the details , of the charges placed --I fully agree with Letter writing as suggested , but Only as a Generality of DISGUST & calling for stiffer Penalities & sentancing in the Future when New Guidelines that are Proposed Get put into Law --

I don't think anyone here believes this guy doesn't deserve a fair trial. Anything less would be Un-American. However, it is also our right, as Americans, to call for full prosecution, and if found guilty, judgement of maximum penalties.

We can't continue to coddle poachers.

The guy should get the maximum penalty allowed. With that said, I don't think it's in the best interest of justice to try and influence a judge on a non jury trial by writing letters. Letters to a prosecutor seem to be the thing to do.

I have problems with the tactics as well. It just aint right to be calling out people in public. Yes the info is free & open to the pubic, but to put it right infront of everyone to benifit the your own agenda is just... well for lack of better words, in bad taste. To me, it kinda cheapens the groups image. Low level tactics=poor image in my book.

I am all for conservation, supporting the bay, protecting fish (all fish, not just stripers) & all that good stuff... but it's exacly stuff like this that stops me from joining CCA and the like.

Say you or of your kids had commited some minor (yes, poaching is a minor crime) crimes in the past or had some issues with the law, would you want the local homeowers assoc. putting a big sign near your house listing all of the charges? This is no different.

It's not wrong to do, but it just aint right either.

It's certainly your right to think that way, Jug. I'd caution you on excusing this behavior as minor crimes done by a kid. This gentlemen is an adult with a long life ahead of him, but he is an habitual poacher. No amount of coddling or boyhood excuses will make this go away. He did the crime, now it's time to face the music.

I think this fits with what Skip was saying in his other thread - Poaching cannot be tolerated.

No ONE is advancing an agenda on the back of Mr. Janda. Voter voice was meant to educate members/fishermen, on how to provide input to the proper officials instead of wasting energy in every direction.

Removing habitual poachers from the water should be important to everyone.

Find me a recreational poacher that has half as many offenses, and you'll see an action alert.

OK... Here's another way to look at it.
How do you think these guys get away with it? No one knows what they are doing. They are stealing resources from every citizen of the state. Yet, they continue to get away with it even in light of the recent federal investigation.
I think it is a very useful tool. This guy didn't have one extra crab on his boat one time. He has 43 VIOLATIONS and isn't even 25. Habitual offenders need to be brought into the public eye. Our system of checks and balances is broken. If "We the People" don't stand up, who will?

How many guides & capts run outside the EEZ? How many H&Lers use cast nets to catch fish?

How many CCA memebers would be found on that case search with NRP violations or checkered pasts?? Should they all be called out this board as well. Are you clean? Am I? Is Skip?

If we were all 100% honest with ourselves, what % of the people on this board do you think are not guilty(or have not been caught) of some NRP fishing violation?

As luck would have it, Skip and I are 100% clean. :D

Also, you have just illustrated why there isn't an action alert for every single poaching case. Only the egregious ones are singled out.

Habitual Poachers of all types need to be taken off the water...

---Crow --His Name & Vilolations & date of Trial , are Public Record , His Innocence Or Guilt Are not yet Public Record ,This could Possibly Scuttle your efforts , The Sun Papers article says it all , as Investigative Reporting , Don't Know Lets see --I'm Gone geo.

some people can't see the trees because of the forest! i'm with crow bait, and what he said rings perfectly true i n this old guys hayd.
make all the excuses you want, but this guy flaunts our judicial system all the way, and should be incarcerated, for a long time.
can't have your cake and eat it , too...! but the criminals in this society do, don't they!!!
