I was down changing out fuel filters and doing some little items I needed done today and was up talking to Dusty at where I am docked in Croatan. While I was standing there we saw a large cabin cruiser come in doing 7 or 8 knots and we tried to wave them down to slow down but they just kept rocking the boats. Then a little Aqua Blue boat carring more passangers than probably should have been on there. Came by doing about 8knots putting out a wake of about 8 to 10 inches from a 22 foot boat. We tried to wave them to slow down and the young kid at the helm decided to mouth off. So I went down to the dock and we had some words trying to explain to him what "NO WAKE" means. He said the definition of "No Wake" was "by if you caused damage to any boats". As he idled away I told him he was now doing it right and he said, "No this is Idling". I told him he needed to learn more about boating and may be try taking a captains course.

So for his pleasure the definition as defined by the United States Coast Guard.

A “no wake area” is defined as an area in which a vessel must travel at “idle speed,” as defined in this subdivision. A “vessel” is defined as any motorized floating craft with the exception of any motorized floating craft which (i) is used primarily as a residence, (ii) is a vessel operated by an authorized member or employee of any law enforcement or emergency services agency or organization when used in the performance of official law enforcement or emergency services duties, (iii) is provided as an accommodation, advantage, facility or privilege at any place of public accommodation, resort or amusement, or (iv) is a vessel in commercial service, as defined in Section 2101 of Title 46 of the United States Code

So young man now I hope you have learned something today.

No need for name calling. Just accept that he didn't know and now maybe he does.

You guys are crazy. I always get a good chuckle out of someone calling someone else out. I tell you fellas, be careful. There are some crazy people out there. If your not a cop, don't be a cop. I had a guy mouth off to me at the boat ramp and try to give me a shove. Before he could even get a foot from me my buddy dropped him. Knocked out cold. So, I learned not to mouth off because that could have been me on the ground sucking dirt. Hey, they guy deserved it.

You raised a good issue. I guess thats why they are requiring a safe boaters course in order to operate a boat "safely" and with courtesy. I guess for those who think thats a ridiculious idea they can thank the "Boneheads like the one you encountered I know I have trained my sons (as I was trained by my Ol man) the way to operate a boat safely and with etiquette!

Was your buddy charged with assault?

I had a similar situation at a boat yard in Florida where I keep my boat. Checked in the office and was told to park my boat in a space that had not be occupied for months. There were a few discarded items; a beat-up ladder, cinder blocks and blocks of wood. I get out of my truck and start to place the items off to the side.

This guy comes running up the path, wanting to know who I was and that this was his space. Tried telling him the office manager told me to park my boat here. He keep getting in my face as I was moving the cinder blocks. Finally, I said --fine, I'll move my boat and threw the blocks behind my back on the ground. One of the blocks rolled and landed on his pos ladder. The guy shoves me with both hands.

I regained my balance and told the sob if he ever touched me again, I was going to knock his f'ing teeth out. The guy would not stop -- stayed in my face, yelling. I finally had enough and my fight or flight response must have kicked in because I grabbed him by the throat with one arm and lifted him off the ground. After about 10 seconds I realized I could have really hurt this guy if I wanted to -- so let him go.

We end up in the office telling our stories. The other fellow wanted the cops to be called -- the manager wouldn't do it because it was his word against mine. So the piece of s_it calls the cops himself after I left.

Cops take his report with photographs showing bruising around his neck. The cops never come find me or take my report. Six months later I get served with a warrant at home in Maryland for assault. The Florida State's attorney's office decides to press charges -- no one every contacted me for my side of the story.

So I'm required to obtain an attorney. A get a packet from my attorney containing the sheriffs report, photos, and a victim impact statement. The guy claims he can no longer walk around the boat yard out of fear. He wife also chimes in that she has suffered considerable stress due to the choking of her husband. So now it looks like I'm getting set-up for a civil lawsuit.

My attorney speaks to the State's attorney and they reduce the charge to disturbing the peace with 3 years probation. I cannot believe this is real. I refuse to accept the plea because of the impact it would have in a civil trial and in my eyes I did nothing wrong -- this guy started the physical contact.

I forgot one important piece of information -- while in the office, when asked by the manager who pushed who first -- the other guy says -- I might have touched him. I'm 5 days from trial, I have to fly to Florida and there's the potential I could lose and face jail time. I try getting the State's Attorney to speak to the office manager. The attorneys office refuses to contact the manager. I had to brow beat my attorney to call the guy. Finally, my attorney and then the State's Attorney talk to the manager and charges are dropped.

People that know me are shocked I was charged with assault. I'm laid back and hate fights. The last fight I was in was back in jr. high. I'm $5,000.00 lighter in the wallet due to attorney fees. In retrospect, -- I probably should have called the cops initially -- but nobody f_cks with me in the boat yard.

KWB he had now one behind him going left before the bidge and myself and the boat before me both asked him to slow down. We see a lot of boat traffic but close to planing is not no wake.

Remember a 40 and 50 foot boat at idle is faster than your boat probably and does not make as much wake at that speed.
